PHOTOGRAPHY & VIDEOGRAPHY CLIENT AGREEMENT

1. General Terms and Conditions

1.1. The Client agrees to cooperate and follow the reasonable directions of the Photographer/Videographer to ensure successful results.

2. Session Expectations and Conduct

2.1 The Photographer/Videographer reserves the right to terminate the session if the Client fails to comply with instructions or behaves in a manner deemed unsafe or disruptive.

2.2 Location Requirements

2.2.1 If the session occurs on private property, the Client must obtain all necessary permissions and permits.

2.2.2 The Client is responsible for any costs associated with location access, including fees or parking permits.

3. Photographer/Videographer Responsibilities

3.1 Performance Standards

3.1.1 The Photographer/Videographer agrees to deliver high-quality, professional-grade media based on their expertise and creative vision.

3.1.2 While every effort is made to capture key moments, no specific shots are guaranteed due to the unpredictable nature of events and environments.

3.2 Equipment and Backup

3.2.1 The Photographer/Videographer uses professional-grade equipment to ensure high-quality results.

3.2.2 Backup systems are in place to protect against equipment failure, but liability is limited to rescheduling or refunding the deposit if technical issues arise.

4. Media Usage and Copyright

4.1 Ownership of Copyright

4.1.1 The Photographer/Videographer retains full copyright ownership of all media created during the session.

4.2 Client Usage Rights

4.2.1 The Client is granted personal, non-commercial usage rights to the delivered media.

4.2.2 Commercial usage requires a separate licensing agreement.

4.3 Photographer/Videographer Usage Rights

4.3.1 Media may be used for promotional purposes, including portfolios, advertisements, social media, and website content.

4.3.2 Media will not be sold to third parties without prior written consent from the Client.

5. Social Media and Collaborative Use

5.1 Social Media Growth

5.1.1 The Photographer/Videographer may share session highlights on social media platforms for account growth and audience engagement.

5.1.2 Tags or credits to the Client will be included where applicable.

5.2 Collaboration Opportunities

5.2.1 The Photographer/Videographer welcomes collaborations with Clients who express explicit interest in co-branded promotions or creative projects.

5.2.2 Collaboration opportunities include joint posts, influencer marketing campaigns, or behind-the-scenes content creation.

5.3 Opt-Out Clause

5.3.1 Clients may opt out of social media usage by submitting a written request prior to the session.

6. Liability and Indemnification

6.1 Limits of Liability

6.1.1 The Photographer/Videographer is not liable for:

• Delays or cancellations caused by events outside their control (e.g., weather, traffic, illness).

• Loss or damage to photographs/videos once delivered to the Client.

6.1.2 In case of technical issues resulting in media loss, liability is limited to rescheduling the session or refunding the deposit.

6.1.3 If data loss occurs due to a technical error despite all precautions, the Photographer/Videographer will make every reasonable effort to retrieve the lost data. In the worst-case scenario where data recovery is unsuccessful, a re-shoot will be arranged if possible. If a re-shoot is not feasible, the Client will be offered either a 25% refund on the effort cost or a complimentary shoot as compensation.

6.2 Client Responsibility

6.2.1 The Client is responsible for ensuring the safety of their property and personal items during the session.

7. Privacy and Confidentiality

7.1 Data Privacy

7.1.1 The Photographer/Videographer will handle all Client data securely and will not share personal information with third parties without consent.

7.2 Media Confidentiality

7.2.1 Any media not publicly shared by the Photographer/Videographer will remain confidential unless otherwise agreed upon.

8. Dispute Resolution

8.1 Mediation

8.1.1 Any disputes arising under this Agreement will first be resolved through mediation.

8.2 Governing Law

8.2.1 This Agreement shall be governed by and construed in accordance with the laws of [State/Country].

9. Model Release and Permissions

9.1 Model Release

9.1.1 The Client grants the Photographer/Videographer permission to use their likeness for lawful purposes, including advertising, promotion, and portfolio display.

9.1.2 If minors are involved, the Client certifies they are the legal guardian authorized to sign on their behalf.

10. Final Agreement

10.1 Entire Agreement

10.1.1 This Agreement constitutes the entire understanding between the parties and supersedes any prior agreements.

10.2 Amendments

10.2.1 Amendments must be read and accepted in writing over email.
